Terms of Service

Welcome to Attoric, LLC. DBA Attoric Games ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our game-hosting services ("Services"). By using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

1. Acceptance of These Terms

By creating an account, purchasing, or using any Attoric Games Service, you accept and agree to be bound by these Terms in full.

2. Eligibility

You must be at least 18 years old—or the legal age of majority in your jurisdiction—or have verifiable parental or legal-guardian consent to administer an account.

3. Account Security

You are solely responsible for safeguarding your login credentials and for all activity occurring under your account. Notify us immediately of any unauthorized use.

4. Service Description & Availability

The Services include game-server hosting, optional paid Cloud Backups, and related infrastructure delivered on a "commercially reasonable efforts" basis. We do not warrant continuous, error-free, or secure operation and may modify or suspend the Services at any time with or without notice.

5. Cloud Backups (Optional Add-On)

• Scope: Replicates designated server data to secondary storage while the add-on subscription is active.
• No Guarantee of Restoration: Backup data is provided "as-is." We make no guarantee regarding completeness, integrity, or restorability and may charge a fee for manual recoveries.
• Retention: Snapshots are rotated on a rolling basis (currently seven daily copies) and are purged on service cancellation or within seven days of add-on lapse.

6. Customer Data & Backup Responsibility

You are solely responsible for creating and maintaining independent copies of all data—including worlds, configurations, databases, and user records—regardless of any fault, negligence, or misconduct by Attoric Games. The Company shall have no liability—direct, indirect, or otherwise—for loss, corruption, or destruction of Customer data.

7. Acceptable Use

You agree not to:

• Distribute or host unlawful, infringing, or malicious content;
• Disrupt or harm the Services or networks of others;
• Attempt unauthorized access to any system or data;
• Impose an unreasonable load on our infrastructure.

We may suspend or terminate Services immediately for violations.

8. Fees, Taxes, and Payment

Prices are posted on our website and may change with 30 days' notice. All fees are billed in advance and are exclusive of taxes, which you are responsible for where applicable. All payments are final, non-refundable, and non-creditable. No refunds or credits will be issued for: (i) partial use or unused portions of any Service period; (ii) downgrades; (iii) early cancellation; (iv) dissatisfaction with performance, reliability, or features; or (v) downtime or maintenance events.

9. Cancellation, Suspension & Data Deletion

You may cancel the Services at any time through the client portal; cancellation is effective immediately, and all associated data is permanently deleted. Cancellation does not entitle you to any refund or credit for fees already paid. We may suspend or terminate the Services, with or without notice, for non-payment, Terms violations, or to protect the integrity of our platform or others.

10. Intellectual Property

All software, branding, and content supplied by Attoric remain our exclusive property. You receive only a limited, revocable, non-transferable license to use the Services.

11. Warranty Disclaimer

THE SERVICES—INCLUDING CLOUD BACKUPS—ARE PROVIDED "AS-IS," "AS-AVAILABLE," AND WITH NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

12. Limitation of Liability

(a) In no event shall Attoric Games be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, revenue, savings, or data, or third-party claims). (b) Aggregate Cap: Attoric Games' total cumulative liability for all claims shall not exceed the fees you paid for the affected Service during the single one (1) calendar month immediately preceding the event giving rise to the claim. (c) Nothing herein limits liability for gross negligence or willful misconduct where unenforceable by law.

13. Indemnification

You will indemnify and hold harmless Attoric Games and its affiliates from any claim or expense arising out of your use of the Services or breach of these Terms.

14. Modifications to the Terms

We may update these Terms at any time. For material changes, we will post the revised Terms and provide 30 days' advance notice by e-mail or portal alert. Continued use after the Effective Date constitutes acceptance.

15. Governing Law & Venue

These Terms are governed by Iowa law. Exclusive venue lies in the state or federal courts located in Polk County, Iowa, and you consent to personal jurisdiction therein.

16. Severability

If any provision is held unenforceable, the remainder remains in full force, and the invalid provision is replaced by an enforceable term that most closely reflects the original intent.

17. Entire Agreement

These Terms constitute the entire agreement between you and Attoric Games regarding the Services and supersede all prior understandings.
